Recent Examples of Workers’ Compensation Awards & Settlements

  • Body Part: neck; right shoulder
  • Injury: cervical strain w/ mild spondylosis; shoulder contusion
  • Amount: $27,000
  • Claimant was stuck with a muffler that had fallen off a shelf at an auto repair shop.  The reasonable and necessary medical treatment included a course of physical therapy, one cortisone injection to the shoulder, and one epidural injection to the cervical spine.

 

  • Body Part: cervical spine
  • Injury: multi-level disc herniation
  • Amount: $42,000
  • Claimant sustained injury moving heavy furniture in the course of his employment with Wal Mart.  He initially had a pain management injection before subsequently undergoing a multi-level fusion surgery.

 

  • Body Part: face, eye
  • Injury: right orbital blowout fracture
  • Amount: $35,000
  • Claimant sustained a severe facial injury while employed as a teacher when he was struck in the face with a stapler.  He underwent surgery to repair a right orbital blowout fracture. The operation required installation of a Medpor titanium implant.   The Claimant missed approximately 7 months from work before returning to his preinjury employment.

 

  • Body Part: leg
  • Injury: distal tibia/fibula fracture
  • Amount: $30,150
  • Claimant fractured her right ankle when she tripped on a cord at her place of employment.  She treated nonoperatively, initially being placed in a walking boot.  Claimant underwent a course of physical therapy after the boot was removed.  A functional capacity evaluation was also performed, which placed Claimant on permanent work restrictions.

 

  • Body Part: ankle
  • Injury: torn Achillies tendon
  • Amount: $40,086.66
  • Claimant sustained a torn Achillies tendon while playing basketball during the course of her employment.  She was initially placed into a walking boot and treated conservatively. She had a two month course of physical therapy, followed by two weeks of aqua therapy.

 

  • Body Part: lumbar spine
  • Injury: L4-L5 disc herniation
  • Amount: $50,000
  • Claimant sustained injury while moving heavy barrels at work.  He underwent a course of physical therapy and 3 epidural steroid injections, but the injury did not require surgery.

 

  • Body Part: knee
  • Injury: torn medial meniscus
  • Amount: $36,600
  • Claimant injured his knee shoveling icy steps at work.  He underwent an arthroscopy that was followed up post operatively by physical therapy and injections.  Claimant returned to work approximately six weeks after surgery.

 

  • Body Part: knee
  • Injury: torn medial meniscus
  • Amount: $25,725
  • Claimant sustained injury to the knee while landscaping at work.  He underwent a surgical repair of the meniscus that was followed by a course of physical therapy.

 

  • Body Part: shoulder
  • Injury: pectoralis tendon rupture
  • Amount: $25,000
  • Claimant sustained injury to the shoulder when he caught himself falling from scaffolding.  The proposed course of treatment was an open pectoralis repair with possible allograft reconstruction.

 

  • Body Part: elbow
  • Injury:  lesion of the ulnar nerve
  • Amount: $ 26,381.25
  • Claimant injured her elbow during the course of her employment as a nurse, requiring surgical repair.  She underwent an anterior subcutaneous ulnar nerve transposition.  Following surgery Claimant worked an extensive period of light duty before being released to return to work without restriction approximately one year after her date of injury.

 

  • Body Part: shoulder
  • Injury:  acromioclavicular joint dysfunction & rotator cuff impingement
  • Amount: $ 25,000
  • Claimant injured her shoulder at work but an MRI did not reveal a rotator cuff tear.  However, after conservative treatment including physical therapy and home exercises failed, Claimant underwent a right shoulder diagnostic arthroscopy.  Postoperatively, she completed a course of physical therapy before returning to work full duty.

 

  • Body Part: back
  • Injury: L5-S1 disc herniation
  • Amount: $36,850
  • Claimant injured his back during the course of his employment at a restaurant.  He initially treated conservatively with a chiropractor and steroid injections.  However, when conservative measures failed, Claimant underwent a surgical repair.  The operation was followed by a course of physical therapy.
